Bartling v. Superior Court (Cal. App. 2d Dist. Dec. 27, 1984), 163 Cal. App. 3d 186, 209 Cal. Rptr. 220. There can be an exception if the employee has already signed some sort of “consent” to medical treatment form as a condition of employment.
